Many directives and regulations address product compliance worldwide. Yet it is still practically impossible to cover all risks for all consumer products. The solution in this article is a broad-based legislation to fill possible gaps and to complement existing and future legislation. <\/span><\/p>

This “one for all” solution is provided by the current General Product Safety Directive and its successor the General Product Safety Regulation (GPSR)<\/strong>. <\/span>It provides a ‘safety net’ to ensure a high level of protection of safety and health of consumers.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t

On\u00a023 May 2023<\/strong>, the General Product Safety Directive (GPSD)\u00a02001\/95\/EC<\/span><\/a>\u00a0has been replaced with the General Product Safety\u00a0Regulation\u00a0(GPSR)\u00a0(EU) 2023\/988<\/span><\/a>. <\/span><\/p>

Health is defined as complete physical,\u00a0mental and social\u00a0<\/strong>well-being and not just merely the absence of disease or illness.\u00a0<\/span>Assessment of mental health of especially children using connected products is required.<\/span><\/p><\/td><\/tr>

Assessment<\/strong><\/p><\/td>

Manufacturers shall carry out an internal\u00a0risk analysis<\/strong>\u00a0and draw up a technical file.
<\/span>Attention to the most vulnerable consumers, such as children and older persons remains essential and is extended with risks for persons with disabilities.
<\/span>The aspects for the safety assessment have been extended with risks of emerging technologies such as cybersecurity (hacking, privacy), artificial intelligence (predictive, learning products), robotics, and 3D printed articles.<\/span><\/p><\/td><\/tr>

Design<\/strong><\/p><\/td>

The GPSR emphasises that a high level of safety should be primarily be achieved\u00a0by design\u00a0and products should \u201cnot present any risk\u201d. The non-avoidable remaining risks should be addressed with warnings and instructions<\/strong>.<\/span><\/p><\/td><\/tr>

Processes<\/strong><\/p><\/td>

It is compulsory for economic operators to have internal<\/strong>\u00a0processes<\/strong>\u00a0for product safety. Procedures should be present to make sure that products produced in series remain in conformity.<\/span><\/p><\/td><\/tr>

Food imitations<\/strong><\/p><\/td>

Non-food products that are likely to be confused with foodstuff should be considered dangerous. Directive\u00a087\/357\/EEC<\/span><\/a>\u00a0is repealed by the GPSR.<\/span><\/p><\/td><\/tr>

Chemicals<\/strong><\/p><\/td>

A safety net for chemical risks in products not covered by specific legislation. This includes environmental risks as much as safety and health of consumers.<\/span><\/p><\/td><\/tr>

Software<\/strong><\/p><\/td>

Identification<\/strong><\/p><\/td>

Products shall bear identification such as a type, batch or serial number<\/strong>.
Name, postal\u00a0<\/strong><\/span>and electronic<\/span><\/strong>\u00a0address of the manufacturer<\/strong> shall be placed on the product.
<\/span>In the case non-EU manufacturers contact information shall also be provided about the EU-based \u2018Responsible Person\u2019.
Any economic operator shall keep information about who has supplied them with the product (part, component, software) and to whom they have supplied the product.<\/span><\/p><\/td><\/tr>

Responsible Person<\/strong><\/p><\/td>

A product may be placed on the market only if there is a Responsible Person (an economic operator)\u00a0<\/span>established in the EU<\/span>. The name, postal and electronic address, of the responsible person shall be indicated on the product or on its packaging.
<\/span>The Responsible Person shall regularly check the compliance<\/strong> with the technical documentation, product and manufacturer information, instruction and safety information.
Evidence of the regular checks shall be documented.<\/span><\/p><\/td><\/tr>

Online sales<\/strong><\/p><\/td>

Webshops, online markets or distance sales shall clearly display the following information about the products offered: name and contact details of the manufacturer; name and details of the EU responsible person; identification of the product, including a picture of it; and\u00a0any warning or safety information in a language easily understood by consumers.<\/span><\/p><\/td><\/tr>

Economic operators<\/strong><\/p><\/td>
