Hong Kong Customs Participated in the 26/27th SAFE Working Group Meeting Organized by the World Customs Organization13 April 2022 Officers from the Office of Trade Relations and Public Communication (OTPC) of the Customs and Excise Department attended the 26/27th SAFE Working Group (SWG) Meeting held by the World Customs Organization (WCO) from 11 to 13 April 2022 to review AEO international standards.  Under the pandemic, the SWG Meeting was conducted virtually and participated by 170 delegates representing Customs administrations, the private sectors and international organizations concerned. Among others, the SWG Meeting was responsible for developing the two-year work plan and kicking start the new round of review for the SAFE Framework of Standards (FoS), which would be conducted at every 3-year cycle.  OTPC will continue to actively engage in essential international discussions to keep abreast of the global development of the AEO Programme and Mutual Recognition Arrangements with a view to providing updated information and more facilitative measures to stakeholders in the global supply chain.   OTPC officers attended the 26/27th SAFE Working Group Meeting (virtual meeting) organized by the WCO between 11 and 13 April 2022.

The list of Politically Exposed Persons (“PEP”) is useful for Subscribers for the conducting Customer Due Diligence (“CDD”) analysis. The common definition of PEP is: an individual who is or has been entrusted with a prominent public function in a recongised jurisdiction andincludes a head of state, head of government, senior politician, senior government, judicial or military official, senior executive of a state-owned corporation and an important political party official; butdoes not include a middle-ranking or more junior official of any of the categories mentioned in subparagraph (1);a spouse, a partner, a child or a parent of an individual falling within paragraph (a), or a spouse or a partner of a child of such an individual; ora close associate of an individual falling within paragraph (a);ECM has provided a List of PEP readily available for Subscribers to conduct Online search or ECM’s assisted search upon request by the Subscribers. The ECM’s Lists of PEP contain records of those named subject persons largely conforming to common definition of PEP. For the purpose of CDD compliance, Subscribers are advised to require their clients to supply a list of the subject clients’ respective spouses, partners, children, parents and close associates for PEP checks. Therefore, it is highly advisable for Subscribers to consult their own legal advisers whether such subject person is regarded as a PEP for the purpose of the Subscribers’ need in compliance with their respective legal and/or regulatory obligations. Note: Pursuant to Hong Kong SFC’s Guideline on AML &amp; CTF (2023-06 Edit), licensed institutes are required to perform CDD on both Hong Kong and non-Hong Kong PEP checks. This search may only generate those records having a positive match withBOTH English and Chinese name fields of our records. The use of this "two" name fields search will deduct two search units from the User's account. Subscribers are advised to conduct a identity verification of the Subject Person should there be any positive result from a PEP check due to possible common name of the concerned persons.

Business Registration Search (“BR”)We provide 3 types of BR Searches conducted from the Inland Revenue Department on behalf of the Member/Subscriber. Companies Registry Search

Members/Subscribers may conduct Court Lead Search by entering the full or part of any target subject name (individual or entity) as an INITIATING PARTY (e.g. Applicant, Claimant, Plaintiff, Appellant, etc.) or a RESPONDING PARTY (e.g. Debtor, Defendant, Respondent, etc.), or a valid court case number. Category of the respective parties will be shown for reference after login. Your search may be refined by selecting all or selective courts and search period so that you will not be overloaded with all related and repeated information and/or records with similar names. Your search will yield a court search report based on a court action for your reference should the target subject information provided by you responded with a positive match with any record in eCML’s Court Lead database through the Court Lead Search. The Court Lead Search will not display the name of a defendant for his/her fresh appearance before a criminal court as information of fresh cases will normally not be shown on the daily court lists. In addition, names of criminal case defendants/respondents aged under 16 will be kept anonymous by the Court and accordingly will not be shown in the Court Lead Search result. Members/Subscriber has an option of using different input methods for Court Lead Search: Single target subject input – Subscriber may input the target subjects individually in the search field to perform the Court Lead Search, ORTarget Subjects BATCH input – Subscriber may upload a Target Subjects List containing all the Target Subjects to be searched in the Excel table provided to perform the Court Lead Search in one lot.
