The ECM’s Lists of PEP contain records of those named subject persons largely conforming to common definition of PEP. For the purpose of CDD compliance, Subscribers are advised to require their clients to supply a list of the subject clients’ respective spouses, partners, children, parents and close associates for PEP checks. Therefore, it is highly advisable for Subscribers to consult their own legal advisers whether such subject person is regarded as a PEP for the purpose of the Subscribers’ need in compliance with their respective legal and/or regulatory obligations. Note: Pursuant to Hong Kong SFC’s Guideline on AML &amp; CTF (2023-06 Edit), licensed institutes are required to perform CDD on both Hong Kong and non-Hong Kong PEP checks.
